Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Sellcrow’s websites, beta software, and related services (the “Service”). By creating an account, connecting eBay, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and accounts

You must be at least 18 years old and legally able to enter into these Terms. You must provide accurate information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account.

Private beta

Sellcrow is currently offered as a limited beta. Access is by invitation, may be changed or withdrawn, and may include unfinished or experimental features. The beta is free and does not require a credit card. We will notify you before introducing any Sellcrow subscription charge that would apply to you.

Connecting eBay

You may connect only an eBay account that you own or are authorized to manage. Connecting eBay authorizes Sellcrow to access the data and perform the actions described on eBay’s consent screen and within Sellcrow. Sellcrow never needs your eBay password.

Your use of eBay remains governed by the eBay User Agreement, the eBay policies applicable to your account and listings, and the applicable eBay API License Agreement. You agree not to use Sellcrow to violate those rules. To the extent required by the eBay API License Agreement, eBay is a third-party beneficiary of these Terms and may enforce the provisions concerning eBay services and content.

Listing actions and automation

Sellcrow may analyze listing activity, make recommendations, and, when you enable or approve an action, update, end, recreate, or otherwise manage eBay listings. You control your automation settings and remain responsible for reviewing them, confirming listing accuracy, maintaining available inventory, and complying with applicable laws and marketplace rules.

Listing actions may be delayed, rejected, duplicated, or otherwise affected by eBay, network interruptions, stale data, or software errors. Review your eBay account after material actions. Pause automation or disconnect Sellcrow if results appear incorrect.

Fees, sales, and taxes

eBay may charge insertion, listing, advertising, transaction, subscription, or other fees when Sellcrow performs an action you authorize. Sellcrow does not control eBay’s fees and does not guarantee that an action will be free, increase views, produce a sale, or improve revenue. You are responsible for eBay charges, customer obligations, taxes, refunds, disputes, shipping, and compliance arising from your selling activity.

Acceptable use

You may not:

• use the Service unlawfully, fraudulently, or to violate eBay policies or another person’s rights;
• access another seller’s account or data without authorization;
• interfere with, overload, probe, reverse engineer, or bypass the security of the Service;
• introduce malicious code or use automated means to scrape Sellcrow;
• resell, sublicense, or provide the Service to another person without permission; or
• use eBay content obtained through Sellcrow for an unrelated purpose, targeted advertising, or training artificial-intelligence or machine-learning models.

Ownership and feedback

Sellcrow and its licensors own the Service, its software, design, branding, and documentation. You retain ownership of information you provide. You grant Sellcrow the limited rights needed to host, process, display, and transmit that information to operate the Service.

If you provide ideas or feedback, you allow us to use them to improve Sellcrow without restriction or compensation. This does not give us ownership of your personal information or eBay account data.

Third-party services

The Service depends on third parties, including eBay and hosting and email providers. We are not responsible for third-party services, their availability, or changes to their APIs, policies, or fees. Sellcrow is independent of eBay and is not endorsed by or affiliated with eBay.

Suspension and termination

You may stop using Sellcrow and revoke eBay access at any time. We may suspend or terminate access if you breach these Terms, create security or legal risk, misuse the Service, or if required by eBay or law. Sections that by their nature should survive termination—including ownership, disclaimers, liability limitations, and dispute provisions—will survive.

Beta disclaimer

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Sellcrow disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, Sellcrow will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, sales, or business opportunities arising from the Service. Sellcrow’s total liability for claims relating to the Service will not exceed the greater of the amount you paid Sellcrow during the 12 months before the claim or $100. These limits do not apply where prohibited by law.

Indemnification

You agree to defend and indemnify Sellcrow from third-party claims, damages, and reasonable costs arising from your listings, products, violation of law or eBay policy, infringement of another person’s rights, or material breach of these Terms, to the extent permitted by law.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in a state or federal court with jurisdiction in Texas, and each party consents to that venue, except where applicable consumer law requires otherwise.

Changes

We may update these Terms as the beta changes. We will post revised Terms and update the effective date. If a material change affects existing users, we will provide additional notice when appropriate. Continued use after the revised Terms take effect constitutes acceptance.
